1. Agreement to these terms

These Terms & Conditions (“Terms”) form an agreement between you and Baxau (“Baxau”, “we”, “us” or “our”). By accessing or using baxau.com (the “Site”) or submitting an enquiry through it, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

2. What Baxau is (and is not)

Baxau is a matching service and information publisher. We help connect people looking to buy property in Sydney with independent buyers agents, and we publish general guides about the Sydney property market.

Baxau is not a licensed buyers agent, real estate agent, mortgage broker, financial adviser or legal adviser. We do not buy, sell, appraise or negotiate property, and we do not provide financial, legal, taxation or property advice. Any buyers agent you connect with through the Site is an independent third party, responsible for their own advice, services, conduct, fees and licensing.

3. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Site or submit an enquiry.

4. Enquiries and connecting with agents

When you submit an enquiry through the Site:

• You authorise us to share the details you provide (such as your name, contact details, target suburbs, budget and requirements) with one or more buyers agents so they can contact you.
• You agree that the buyers agents may contact you about your enquiry.
• We do not guarantee that you will be matched with any agent, that an agent will respond, or that any particular outcome, price or result will be achieved.
• Any agreement you enter into with a buyers agent is solely between you and that agent. Baxau is not a party to it and is not responsible for the services, advice, conduct or fees of any agent.

You are responsible for making your own enquiries and conducting your own due diligence before engaging any agent or making any property decision.

5. Guides are general information only

Articles, suburb guides and other content on the Site are provided for general information purposes only. They are not personal advice and do not take into account your objectives, financial situation or needs. Property markets change, and information may become out of date. You should obtain your own independent professional advice before acting.

6. Your responsibilities

You agree that you will:

• Provide accurate, current and complete information in your enquiries.
• Use the Site only for lawful purposes and in accordance with these Terms.
• Not misuse the Site, including by attempting to gain unauthorised access, scraping or harvesting data, transmitting malicious code, interfering with its operation, or submitting other people’s personal information without their consent.

7. Intellectual property

The Site and its content — including text, guides, graphics, logos and design — are owned by or licensed to Baxau and are protected by intellectual property laws. You may view and share content for personal, non-commercial use. You must not reproduce, republish or exploit our content commercially without our prior written permission.

8. Third-party links and services

The Site may contain links to, or connect you with, third parties (including buyers agents and other websites). We do not control and are not responsible for their content, services or practices. Links and connections are provided for convenience and do not imply endorsement.

9. Disclaimers and your consumer rights

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no warranties that the Site will be uninterrupted, error-free or secure, or that any information on it is accurate, complete or current.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.

10. Limitation of liability

To the maximum extent permitted by law, Baxau will not be liable for any indirect, incidental, special or consequential loss, or for any loss of profits, opportunity or data, arising out of or in connection with your use of the Site or your dealings with any buyers agent, whether in contract, tort (including negligence) or otherwise.

11. Indemnity

You agree to indemnify Baxau against any loss, damage, cost or expense we incur arising from your breach of these Terms, your misuse of the Site, or your breach of any law or the rights of a third party.

12. Privacy

Our handling of your personal information is described in our Privacy Policy, which forms part of these Terms.

13. Changes to the Site and these Terms

We may update the Site or these Terms from time to time. Changes take effect when we post the updated Terms on this page, with a revised “last updated” date. Your continued use of the Site after a change means you accept the updated Terms.

14. Suspension and termination

We may suspend, restrict or withdraw access to the Site (or any part of it) at any time, including if we reasonably believe you have breached these Terms.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and Baxau submit to the non-exclusive jurisdiction of the courts of New South Wales.
